Project Witness — Terms and Conditions

Welcome to Project Witness, a non-profit organization dedicated to preserving Holocaust testimony and advancing Holocaust education and research. By accessing or using our website, online learning tools, donation portals, or any other digital services operated by Project Witness ("we," "our," or "us"), you agree to be bound by these Terms and Conditions.


1. Purpose and Mission

Project Witness operates as a registered non-profit organization whose mission is to educate, inspire, and commemorate through digital exhibits, research archives, media productions, and educational programs for students, teachers, and the public.


2. Eligibility and Accounts

  • You must be at least 13 years old to use our site.
  • When creating an account or subscribing to our services, you agree to provide accurate and complete information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • Accounts may be suspended or terminated if used in violation of these Terms or applicable laws.

3. Donations and Purchases

  • Donations and paid media access are processed through third-party payment processors (e.g., Stripe).
  • Recurring donations ("monthly") and one-time donations ("one_time") are defined as in our database schema.
  • Refunds are considered on a case-by-case basis for erroneous or duplicate transactions.
  • Project Witness does not sell donor data or share it with third parties except as required by law or for payment processing.
  • Tax receipts will be issued for qualifying donations as per U.S. non-profit regulations.

4. Educational Materials and Digital Products

  • Educational resources, videos, and downloadable materials are licensed for personal, classroom, or institutional educational use only.
  • Resale, redistribution, or modification of materials without written permission is prohibited.
  • Access to digital products may be time-limited, in line with entitlement durations defined in your purchase record.

5. User Contributions

You may submit stories, family histories, translations, or other materials ("Submissions") via our online forms or designated contribution platforms. By submitting content, you:

  • Confirm that the material is accurate and that you own or have permission to share it.
  • Grant Project Witness a non-exclusive, royalty-free, perpetual license to display, archive, and publish your Submission.
  • Acknowledge that Submissions may be reviewed, edited, or declined at our discretion.

6. Volunteer and Community Participation

  • Volunteer opportunities may include translation, transcription, and digital contribution projects.
  • Project Witness reserves the right to moderate, suspend, or remove participation for conduct inconsistent with our values of accuracy, respect, and historical integrity.

7. Privacy and Data Protection

We are committed to safeguarding personal data, including user profiles, donation history, and contact information. Data is securely stored and processed in accordance with applicable data protection laws. Our full Privacy Policy will explain:

  • What personal information we collect;
  • How it is used (e.g., to issue receipts, enable access to purchased materials, or send newsletters);
  • How to request deletion or correction of your data.

8. Intellectual Property

All content on Project Witness platforms—including videos, lesson plans, research materials, design elements, and databases—is protected by copyright and related laws. You may not use, reproduce, or distribute our materials except as expressly permitted under these Terms or applicable educational fair-use provisions.


9. Third-Party Services

Our website may link to or integrate with third-party platforms (e.g., Stripe, Supabase, Vercel, Cloudflare Stream). We are not responsible for third-party services or their content, terms, or privacy practices.


10. Disclaimers

  • Educational and archival materials are provided for informational and commemorative purposes only.
  • While we strive for accuracy, Project Witness makes no warranties regarding completeness or reliability of content.
  • We are not liable for losses resulting from use or inability to use our site, except as required by law.

11. Termination

We may suspend or terminate access to your account or digital entitlements if you breach these Terms or misuse our services.


12. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the appropriate state or federal courts located in New York.
